“Friend of the Court” Letter
Hello. My name is Rhiannon and I am a property owner in Rimrock Meadows and an Association member in good standing.
I have written an Amicus Curiae, or "Friend of the Court," letter in the matter of Rimrock v. Danby.
I invite you to read the letter, exhibits, and case documents — and to co-sign the letter if you support it.
Thank you to all who cosigned the “friend of the court” letter either in person or online. The letter was filed with the court on Monday, February 23, 2026, and mailed via U.S. Priority Mail to both the Plaintiff (Rimrock) and the Defendants (the Danbys) via their attorneys.
I can't promise the judge will allow the letter to be admitted.

Who was noticed for deposition?
On January 9, 2026, Defense counsel at Moberg Law Group sent Notices of Deposition and Subpoenas for all seven of these board members to plaintiff's attorneys (Meyer, Fluegge & Tenney):
Sam Ingvarsson, Stan Marsh, Mark Mahoney, Leah Cunningham, BJ Cunningham, Gerald Dotson, and Kevin Foley.
Foley's Notice and Subpoena are both explicitly listed as attachments.
The critical detail: The Certificates of Service in the documents consistently show that service was delivered to plaintiff's attorneys by email — not to the individual board members personally.
Defense counsel's email even included this telling line: "If you ARE NOT accepting service for the Rimrock Board Members named above, please advise asap."
There is no document in the case files showing that plaintiff's counsel responded to confirm they were accepting service on behalf of the board members.
